“In the instant case accused contended that the conviction on an indictment for a second offense of driving an automobile under the influence of intoxicants, where the indictment contained the word “feloniously,” deprived accused of his elective franchise rights under section 23 of the Constitution of 1902. Held: That the conviction did not deprive accused of the elective franchise. Therefore, the Supreme Court of Appeals directed that its order affirming the action of the lower court should show on its face that the conviction was on a misdemeanor charge.” Young v. Com., 155 Va. 1152, 156 S.E. 565 Va. 1931.
