Virginia Traffic Ticket Speeding Ticket Reckless Driving

“Plaintiff testified that he was driving at a permitted speed of forty-five or fifty miles per hour and defendant’s car pulled out from a restaurant’s parking space into the highway suddenly and without warning two or three car lengths ahead of him, and it was impossible for plaintiff to have avoided the collision. Section 2154(108) of the Code of 1942 (Michie) provides that irrespective of the maximum speeds established by state law, any person who drives a vehicle upon a highway at a speed or in a manner so as to endanger life, limb or property, or who exceeds reasonable speed under the circumstances and traffic conditions existing at the time, shall be guilty of reckless driving. Held: That under section 2154(108) it was for the jury to say whether plaintiff, in proceeding at an admitted speed of from forty-five to fifty miles per hour past the parking space from which defendant’s car was entering the highway, was driving at a speed in violation of the section’s provisions.” Davis v. Webb, 189 Va. 80, 52 S.E.2d 141 Va. 1949.
